It was with the FC3 2.6.9 & 2.6.10 kernels.  This is not happening with 
a vanilla 2.6.10 kernel on a FC2 system with the same controller.

I've not had time to work on it since discovering it was a known FC3 
kernel bug.  I'm theorizing that its just a problem with the FC3 kernel, 
and not a problem with any 2.6.x kernel on FC3.
