Of course it's actually sort of clever in a perverse sort of way. In the
IBM suit they have been claiming IBM helped Autozone port their precious
libraries--i.e., something they actually own--to Linux in the
conversion. So as long as they can credibly claim that, they have a
case. And they can go on about it in the press in hopes that others won't
make the distinction. Might sell a few of their damn licenses or get the
stock price a little higher.
