I don't think the problem is limited just to the digital realm, but that the
entire system needs an overhaul. It wouldn't be so bad if it didn't cost so
much to argue against a patent, but it's so expensive that only the "big
mules" with deep pockets can afford to argue a patent, and, as you point out,
they control the system. (Meanwhile, I don't think that the people who work
for the patent office have a clue about the patents they are issuing.)
