When does it appear in the "middle of a user program"?
Nesting menus with "p menuname" (which used to be required under DOS,
as it didn't support "!menuname") hasn't caused a second splash screen
for quite some time. Although Windows has supported "!menuname" for
some time now, there is no need to change "p menuname" commands to the
other syntax to avoid multiple p's from loading.
How old is your p.exe?
