I'm coming into this late as I spent this week catching up after
6 days in Bryce and Zion Canyons (some photos may end up on my
web site when I get a bit of time :-)
After reading the groklaw article below last night, it appears
that several members of the Samba team were largely responsible
for the EU's court really understanding the issues involved. I
particularly like the comments pointing out that Microsoft
couldn't buy off the Samba group as they did many of the original
complainants.

The facts that FOSS software cannot be orphaned when a company
goes out of business, and that even a company with Microsoft's
assets and political clout can't intimidate or buy off the
amorphous mass of FOSS developers, should be very positive
factors in any business decision.
