I suspect that the MS EULA has sufficient escape clauses. No one really
owns a copy of Windows,
people just board it in ther computers.
On the other hand, it may be possible to apply nuisance statutes against
people whose infected computers are sending the spam. A nuisance does
not require intent, or even awareness, of the delinquent. If the owner
of an infected computer fails to remediate a nuisance that occurs on, or
in, his property, after being duly notified by authority, he is guilty.
