Appellate Court Gives CAPR Summary Judgment Win in Clearing and Grading
Limits Case!

 

The Division I Court of Appeals gave Pacific Legal Foundation, CAPR and
rural property owners an Independence Day present early yesterday.  In its
opinion released July 7th, the Court essentially declared King County's set
clearing limits to be unlawful.  These are the sections from the King County
Clearing and Grading Ordinance which mandated that rural area property
owners have to leave 50% to 65% of their land in its native state,
essentially confiscating the land to satisfy its open space agenda.  Many
considered these rules to be the worst of the three ordinances passed into
law on January 1, 2005 after a long, bitter fight between CAPR and King
County.

 

King County now has thirty days in which it can either appeal the case to
the Washington Supreme Court or let the ruling stand.  If appealed, the
rules will stay in effect until that appeal is exhausted.  At a minimum, the
rules will be in effect for the thirty day period.

 

This is a huge victory for the civil rights of citizens in rural King County
and will most likely have statewide implications.  We thank Brian Hodges and
Pacific Legal Foundation for being there to help CAPR defend our basic
rights.  It is tough to take on this type of fight without the likes of PLF
in your corner.

 

We will write more about this in the next edition of CAPR News later this
month.  Until then we will monitor developments and keep you posted as
warranted.

The next meeting of the King Co. chapter of CAPR will be held at 7:00 PM,
Thursday, August 7th.  The meeting site is the IHOP restaurant located at
1433 NW Sammamish Rd. in Issaquah.  Consider coming early for dinner and
