Dear CAPR colleagues (and feel free to forward to others interested in honest and open government and politicians - and ask them to join the email list by going to www.proprights.org),
Just a reminder re: the court hearing this Friday morning for the Dow Constantine recall at which the court will rule on whether my recall can proceed and I can start gathering signatures - or, if I am going to have to appeal to the state Supreme Court. As you may know, the county has hired the Preston, Gates, etc. law firm to defend Constantine - at taxpayer expense. If I win, there's a good chance Constantine will appeal to the state Supreme Court, since he can, at no cost to him...
The court hearing is set for 10 AM, Friday, February 11, 2005 in the King County Courthouse, downtown Seattle (3rd/4th Avenues and James Street), Courtroom W-813, before Judge Jeffrey Ramsdell. My lawyer, Charlie Klinge, estimates it will be approximately a one hour hearing. I am expected to take the stand and be questioned by the judge and, possibly, by Constantine's lawyers.
By the way, you should know that it looks like Dow Constantine and/or his agents have infiltrated this email list. In a brief filed yesterday, his lawyers attached a number of my emails that I had sent to this list, and have tried to use my statements in my emails to you against me and the petition for recall. This was not unexpected, and is not a problem. However, you should be aware that it appears anything any of us say on this discussion list is being monitored by Dow Constantine or his supporters. If any of you have anything to say to me or anyone else that you want to keep private, address it only to me or the applicable individuals. If you email me, please include your phone number, as sometimes my schedule is such that it works out better for me to respond by phone.
I would also like to take this opportunity to thank all of you who have donated financially toward the legal fees for Constantine's recall. (I will acknowledge individual contributions privately as soon as I can.) More is needed, but your contributions to date have gone a long way toward helping me with the thousands of dollars in legal costs I've advanced, not to mention thousands more in legal bills I will be receiving and that I am legally obligated to pay regardless. Contributions to help me with the legal costs of the Constantine recall can be made by mailing checks payable to: Groen, Stephens, and Klinge, Attorneys at Law, and mailed to me, Armen Yousoufian, at P.O. Box 950, Vashon, WA 98070-0950. I am collecting the checks, keeping track of the amounts, etc., and turning them into the lawyers every other week or so.
Finally, in anticipation of collecting signatures on the petitions for recall soon, stand by for more information. It could be as early as next week and the weekend of February 19/20, unless the case goes to the state Supreme Court, in which case there will be an approximately 20 day delay.
